COURT CONSIDERING GIRLS'
PARENTS' APPEAL

HOPKINTON A state Appeals Court judge is pondering
an appeal from Heath and Tara Carey, the Hopkinton couple who want to have
direct access to the state fire marshal's investigation of the apartment
building explosion last month that killed their two young daughters. Worcester
Superior Court Judge James P. Donohue ruled last week that allowing the Careys
to participate in the investigation would taint the case. "The
investigation into whether criminal conduct was involved in the explosion cannot
properly be conducted according to law if any interested party is allowed to
intervene in the process," Donohue wrote in his decision. The Careys filed
an appeal this week with the Appeals Court in Boston. A decision could come as
early as today.
